Each Person Admitted to a Nursing Home has the Following Rights:

  • The right to be fully informed, both orally and in writing in a language the resident understands, of his or her rights, and all rules and regulations of the facility regarding resident conduct and responsibilities

  • The right to exercise his or her rights, without interference, coercion, discrimination or reprisal from the facility

  • The right to civil and religious liberties

  • The right to reside in a safe, clean, comfortable, homelike environment

  • The right to private and uncensored communication, including the right to receive mail unopened and use a telephone where calls can be made without being overheard

  • The right to reasonable access to health, social, legal or other services

  • The right to present grievances on behalf of himself or herself or others to the staff or administrator of the facility, to government officials, or to any other person

  • The right to prompt efforts by the facility to resolve grievances

  • The right to organize and participate in resident groups

  • The right to participate in social, religious, and community activities

  • The right to examine the results of the most recent inspection of the facility, and the facility's plan of correction

  • The right to examine, upon request, all records pertaining to himself or herself including clinical records within 24 hours

  • The right to purchase copies of the records or any portion of the records upon request

  • The right to approve or refuse the release of personal or clinical records to individuals outside the facility

  • The right to manage his or her own financial affairs

  • The right to be fully informed of his or her medical condition and proposed treatment

  • The right to refuse medication or treatment and to be informed of the consequences of such decisions

  • The right to refuse to participate in experimental research

  • The right to formulate an advance directive

  • The right to receive adequate and appropriate health care and protective and support services

  • The right to have privacy in treatment and in caring for personal needs

  • The right to be treated courteously, fairly, and with the fullest measure of dignity

  • The right to be free from verbal, sexual, mental and physical abuse, corporal punishment and involuntary seclusion

  • The right to be free from any physical or chemical restraints imposed for purposes of discipline or staff convenience

  • The right to be transferred or discharged only for medical reasons or for the welfare of other residents

  • For residents of Medicaid or Medicare certified facilities, the right to challenge a decision by the facility to discharge or transfer the resident, as required under Title 42 C.F.R. part 483.13

  • The right to receive notice before the room or roommate of the resident in the facility is changed

  • The right to refuse a transfer to another room in the facility under certain circumstances

  • The right to be informed of the bed reservation policy for a hospitalization or home visit

  • The right of freedom of choice in selecting a personal physician

  • The right to retain and use personal clothing and possessions as space permits

  • The right to receive information about establishing eligibility for Medicare and Medicare

  • The right to be informed upon admission and periodically during the resident's stay of the services available in the facility and of the charges for those services, including charges for services not covered by Medicare, Medicaid or the facility's per diem rate

  • The right to refuse to perform services for the facility, or the right to be paid for performing services if the resident agrees to work in the facility

  • If married, the right to share a room with his or her spouse if both parties consent

  • The right to choose activities, schedules and health care consistent with his or her interests, assessments and plans of care

  • The right to make choices about aspects of his or her life in the facility that are significant to the resident

  • The right to reside and receive services in the facility with reasonable accommodation of individual needs and preferences
